Hal diataslah yang dapat dijadikan dasar hukum dalam menjerat pelaku usaha atau pemilik online shop yang menawarkan barang melalui media online namun tidak beritikad baik kepada konsumen dengan menjual barang tidak sesuai dengan yang ditawarkan seperti barangnya palsu , rusak, dan/atau tidak sesuai spesifikasi.
Selain ancaman pidana dan juga sanksi administratif berupa pencabutan izin (Pasal 65 ayat 6 UU Perdagangan) yang tertuang dalam UU Perdagangan, Di dalam UU ITE (Informasi dan Transaksi Elektronik) Pasal 28 ayat 1 juga melarang hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam Transaksi Elektronik yang dimana ancamannya pidana penjaranya maksimal 6 (Tahun) dan/atau denda paling banyak Rp 1.000.000.000,00 (satu miliar rupiah). Oleh karena itu penting bagi para pihak tau akan ketentuan hukum tersebut diatas, agar kepastian hukum bisa terjamin dan tidak ada pihak yang dirugikan.
